Lasting Powers of Attorney

Property and financial affairs LPA

Lets your chosen attorneys look after your money, bills, bank accounts and property, either as soon as it is registered or only if you lose capacity. You decide.

  • Members of The Society of Will Writers

What your attorneys could deal with

  • Bank and building society accounts
  • Paying household bills and managing direct debits
  • Collecting pensions and benefits
  • Managing investments and savings
  • Buying or selling property, including your home
  • Dealing with tax, insurance and repairs

Choosing when it can be used

A property and financial affairs LPA can be set up so that your attorneys can act as soon as it is registered, with your agreement, or only once you lack capacity. Many people choose the first option so that an attorney can help with practical matters, for example if they are in hospital or find paperwork difficult, while they still have capacity.

Instructions and preferences

You can add instructions your attorneys must follow and preferences you would like them to bear in mind, for example about gifts, how your money should be invested or keeping a particular property. We will help you decide whether anything needs adding and how to word it so it does not cause problems at registration.

Common questions

Can my attorneys make gifts from my money?

Only in limited circumstances, such as reasonable gifts on birthdays or at Christmas to people you would normally give to, unless the Court of Protection allows otherwise. Attorneys must always act in your best interests.

Can an attorney sell my house?

Yes, if that is in your best interests and your LPA does not restrict it. If you want to limit this, we can include an instruction.

Do my attorneys have to keep records?

Yes. Attorneys should keep your money separate from their own and keep records of what they do, as they can be asked to account for it.
