Lasting Powers of Attorney

Health and welfare LPA

Makes sure the people who know you best can speak for you about your care, where you live and your medical treatment, if there comes a time when you cannot.

  • Members of The Society of Will Writers

What your attorneys could decide

  • Where you live, including whether to move into a care home
  • Your daily routine, such as diet, dress and activities
  • Medical care and treatment
  • Who you have contact with
  • Life sustaining treatment, but only if you give them that authority in the LPA

When it can be used

Unlike the financial LPA, a health and welfare LPA can only be used once you lack the capacity to make a particular decision yourself. While you can decide, you do. That makes it a safety net rather than a handover.

Life sustaining treatment

The form asks you to choose whether your attorneys can make decisions about life sustaining treatment. If you say no, those decisions are made by the medical team in your best interests. This is a personal choice and we will give you the time and space to make it.

Common questions

Without a health and welfare LPA, who decides?

Doctors and social services make decisions in your best interests, and they should consult your family, but your family have no legal authority to decide. An LPA gives your chosen people that authority.

Can I say what I want in advance?

Yes. You can include preferences and instructions, and you can also make a separate advance decision about particular treatments. We can explain how these fit together.

Can I choose different attorneys from my financial LPA?

Yes. Some people choose the same attorneys for both; others pick someone practical with money and someone close to them for care decisions.
