Wills

Complex wills

Some families and some estates need more than a simple will. We take the time to understand the detail and draft a will that deals with it properly.

When a will needs more thought

Second marriages, children from earlier relationships, a family business, property abroad, a beneficiary who needs long term support, or a wish to protect assets for the next generation all call for careful drafting. A standard will can leave gaps, and gaps cause problems later.

Situations we regularly help with

  • Blended families where you want to provide for a partner and protect children from an earlier relationship
  • Life interest trusts, so a partner can live in the home for life with the property then passing to children
  • Discretionary trusts to give trustees flexibility over who benefits and when
  • Provision for a vulnerable or disabled beneficiary
  • Business and agricultural interests
  • Property or assets overseas
  • Larger estates where inheritance tax needs to be thought about

How we approach it

We start with a longer conversation, usually at your home, to understand your family, your assets and what you are trying to achieve. We then explain the options in plain English, including what each one does and does not do, before drafting. You check the draft, and when it is right we hand deliver it for signing.

Common questions

How do I know if I need a complex will?

If any of the situations above apply to you, it is worth a conversation. We will tell you honestly whether a simpler will would do.

Can a will include a trust?

Yes. Trusts created by a will are common, for example to let a partner stay in the home for life while protecting it for children. We can explain the different types.

What about inheritance tax?

A will can be drafted with inheritance tax in mind, and we can give general guidance on how the rules work. For advice on your own financial position you should speak to a regulated financial adviser.
